Colorado school officials have put the kibosh on a first grade student, Coy Mathis, who is anatomically male but identifies herself as a female, on using the girls’ bathroom.
A Fountain-Fort Carson School District attorney, W. Kelly Dude explained via CNN:
[The district] took into account not only Coy but other students in the building, their parents, and the future impact a boy with male genitals using a girls’ bathroom would have as Coy grew older.
However, I’m certain you can appreciate that as Coy grows older and his male genitals develop along with the rest of his body, at least some parents and students are likely to become uncomfortable with his continued use of the girls’ restroom.
The transgender child’s parents have partnered with the Transgender Legal Defense & Education Fund to file a complaint with the Colorado Civil Right Division. Coy’s parents have issued a response through their lawyer, Michael Silverman:
Coy’s school has the opportunity to turn this around and teach Coy’s classmates a valuable lesson about friendship, respect and basic fairness.
The school has offered Coy and her parents an alternative, saying she can use the faculty restrooms or the boys restroom. The district denies they are violating any civil rights or anti-discrimination laws because they said that Coy is allowed to dress as she pleases and that staff has honored Coy’s family’s request that she be identified as a girl at school, she just has to use a gender neutral bathroom or use the one that corresponds with her current anatomy out of respect for the other students.
Ms. Mathis was on the Katie Couric show recently and she says the school district’s decision teaches other students that they can bully and be mean to children who are not like them.
Currently Coy is currently being homeschooled.
