Cops: Father arrested for murdering drunk driver who killed his kids

David Barajas, 31, of Alvin, Texas, has been arrested and charged with the murder of Jose Banda, 20, after Banda’s vehicle struck Barajas’ children, ages 11 and 12, killing them.

Banda struck David Barajas II, 12, and his younger brother, Caleb Barajas, 11, at around 11:30 pm on Dec. 7 as the boys attempted to push their father’s Ford pickup towards their nearby home. Their father’s truck had reportedly broken down.

Banda rear ended the truck, crushing the children from behind. Barajas’ younger son died instantly. Barajas’ older son was air lifted to a nearby hospital where he later died.

Police say that blood tests reveal that Banda was driving under the influence.

When police arrived at the accident scene, Banda was found with a gun shot to his head. Banda was also taken to a nearby hospital where he also died.

After interviewing witnesses and obtaining a search warrant for Barajas’ home, investigators believe that Barajas went into his house for a handgun with the intention of killing Banda in revenge for crashing into his children. Police found bullets and gun holster inside Barajas’ home, but no gun. Witnesses say they saw Barajas walk to his home and quickly return to Banda’s vehicle when they heard gun shots.

Barajas turned himself into police upon learning that he had been indicted by a grand jury in the murder of Banda. Barajas is currently being held on $450,000 bond.
