Four boys ages 12-13 allegedly gang rape girl, 14, and attempt to rape girl, 12

Four boys have been accused of gang raping a 14-year-old girl in her home multiple times in June and attempting to rape a 12-year-old in the home.

The 14-year-old testified today via closed circuit television that the four boys – three 13-year-olds and one 12-year-old – entered her Ramapo, New York, home and repeatedly raped her over several days.

The 14-year-old girl said that the boys knew of a hidden key outside her home and three of them – two 13-year-olds and one 12-year-old – entered her room on the morning of June 12 and took turns raping her, only stopping to go to school to take a Regents’ exam that they told her they didn’t want to miss.

She said that in spite of her protests, the boys held her down and stripped off her clothing.

She testified that later that afternoon, the three boys returned to her home with another 13-year-old boy and they took turns raping her in the bathroom while they held her by the wrists and she tried to fight them off.  She said that she had been scared they would come back and had hidden in her parents’ bedroom behind the headboard of the bed, but they found her and pulled her inside the bathroom where they took turns holding her and raping her anally and one of the boys also raped her vaginally.

She told the prosecutor that she felt “really grossed out” after the boys left and took a shower.

The 14-year-old testified that on June 13 the boys returned again while she was in her bedroom on a video chat with a friend.  Her bedroom door was locked and she said when one of the boys knocked she told him she was not opening the door.

The girl said that he used a kitchen knife to open the door and entered the room along with the other boys and that he tried to shut down her video call and began trying to touch and undress her.  She told them she was menstruating and she said that after aruging with her they then turned their attack on the 12-year-old in the home and began undressing her.

“I saw [her] kicking [one of the boys] off of her,” she testified. “I was upset seeing [her] without her clothes. I told her to put on my clothes.”

She said that the younger girl kicked and fought the boys, and they eventually fled when the 14-year-old’s father called and said he was on his way home from work.

Assistant Rockland County Attorney Barbara Wilmit asked the 14-year-old several times what she said and did during the attacks and the girl testified that she tried to push the boys off of her.

“I was yelling and screaming to leave me alone,” she testified and told the prosecutor she felt “pain” at being penetrated multiple times in her anus.

According to the girl, two of the boys were doing most of the directing to hold her down, and she was scared because one of those two boys had threatened her the day before the first attack.

The 12-year-old testified that she kicked and screamed and bit two of the four boys while they tried to rape her on June 13.

“They pulled me into (the 14-year-old girl’s) room. I  was screaming, ‘Get off of me!’’, she told the judge during testimony.

The 12-year-old said that she sat on the floor and grabbed her knees while the boys tried to pull her pants off.  She went on to say that the 12-year-old boy specifically attempted to sexually assault her and she fought back by biting him.

“I bit him very hard and he started bleeding,”  the girl said.

Several other young girls are scheduled to testify in the trial.  According to the 14-year-old, there was another witness to the attacks besides the 12-year-old, and she also texted several friends after the attacks and told them what happened.

The 14-year-old and 12-year-old girls did not tell their parents about the alleged attacks until a few days after they occurred.

The 12-year-old said that she and another girl were in the home and heard the 14-year-old screaming during the attacks on the morning on June 12 and tried to break into the bedroom by ramming the door and attempting to pick the locks with a kitchen knife.

She testified that she heard the older girl screaming at the boys to get off of her.

When questioned by defense lawyers as to why she didn’t call the police or her parents, she said that she was scared, embarrassed and worried that their parents would be in trouble for leaving them in the house alone.

Previously the judge had said that the courtroom would be closed during the girl’s testimony, however today she decided to allow the public to hear the testimony of both victims – even if the media outlets intend to publish the names of the accused juveniles.

Some of the boys’ lawyers have said the 14-year-old girl consented to having sex with them and didn’t seem upset in texts she made to the boys and other people.

The boys were all arrested on June 16, the day after the girls told their parents and filed a police report.

Prosecutors said that in police statements the boys have admitted in differing degrees that on June 11 and 12 they sexually abused the two girls, including saying that they held down the 14-year-old girl and took turns raping her.

The 12-year-old boy testified in court that he “swore on everything he loved” that he did not rape the 14-year-old girl and that she consented.

He admitted that the boys were not invited to the house, but that they knew where the spare key was kept and went to the home looking for the 14-year-old girl on June 12.

“We had sexual contact with her the day before (June 11) and wanted to do it again,” the boy testified.

He told the court that he attempted to have sex with the 14-year-old girl on June 12 because he didn’t want to be the only one of the boys that had not had sex with her.

“I didn’t want to be a punk,” he told the court.  “I didn’t want to seem like anyone who didn’t do it.  It was consensual.  I swear on everything I love.  She was even laughing.”

The boy also testified that he and the other boys didn’t believe the 14-year-old when she said she was menstruating and that they argued with her about it for quite some time.

“She didn’t want to do something that day,” the boy explained.

He did, however, admit it was wrong to hold down the 12-year-old girl.

Defense attorneys claim that the boys were invited to the house and they are also claiming that one of the boys spent time laying in bed with the 14-year-old watching TV.  The defense attorneys are also questioning why the girls made comments about the boys on Facebook after the alleged attacks.

The four boys have been charged with felony first-degree rape and sexual abuse offenses.

They are currently under home detention and if convicted could be held in a juvenile detention center until they turn 18-years-old.
