A jury has awarded a woman in Ohio $20 million after they found doctors negligent in leaving her baby stuck in her birth canal for over 13 hours.
[Heather] Grow’s attorneys argued during a medical malpractice trial that the baby suffered brain injuries. Doctors had told Grow months earlier that she had a narrow pelvic arch.
The lawyers say the now 10-year-old girl has limited use of her limbs, has vision problems and is mildly retarded.
The doctors organization Group Health Associates says Dr. Lisa Yang “did everything medically possible to facilitate a healthy delivery.”
On a side note, this incident to place in 1997. Isn’t there something wrong with the system when it takes over 10 years to resolve such things?!

OK, we’re not exactly champions of religion, but we do believe in free choice. So, we definitely side with the teenager who wanted to go to a Catholic high school, despite his father’s objections. Seems like a judge agrees:
Oldham County family court Judge Tim Feeley said in a ruling published Monday that 14-year-old Michael Ryan can attend St. Xavier High School because that’s where he wants to go.
His divorced parents disagreed over whether their son should go to the religious school, which his mother Susan Bisig wanted.
David Ryan’s lawsuit argued that the state’s Constitution says no one can be “compelled to send his child to any school to which he may be conscientiously opposed.”

Treffly Coyne, a mom from Tinley Park, Illinois who was accused by Crestwood police of child endangerment after leaving her child in a car — the charges were later dropped — has filed a lawsuit against the village. Coyne is claiming false arrest and malicious prosecution. Hmmm, while we’re on the side of Coyne in that we think the initial charge was bogus, she might lose some of the goodwill she gained with people that are rather tired of this lawsuit happy society.
Flanked by her husband and three daughters, Ellen “Treffly” Coyne said officers acted brashly and failed to use common sense when they arrested her in December.
“This moment of giving turned into aggressive boom, boom, boom, accusations in a minute,” Coyne said at a news conference in her lawyer’s Loop office.
Coyne’s husband, Tim Janecyk, said the family had hoped to move on with their lives after the charges were dropped last week but decided to file the lawsuit after Crestwood Police Chief Timothy Sulikowski told the media he was disappointed prosecutors did not pursue the case.
The couple said the suit, which seeks unspecified damages, is not about money but is about closure and holding officials responsible.

The parents of Jessica Lunsford, a 9-year-old girl who was raped, tortured, and buried alive in 2005, are suing the Citrus County Sheriff’s Office, the Florida Department of Law Enforcement, and the Citrus County Board of County Commissioners claiming negligence in the investigation into the disappearance of their daughter, and they have reason to believe that the alleged mistakes led to the girl’s death.
The sheriff’s office said Thursday morning that the department has received notice of the lawsuit from Mark Lunsford and Angela Wright, who are Jessica’s parents.
Jessica Lunsford was kidnapped and murdered by John Couey in 2005. It took investigators nearly a month to find Jessica’s body. Couey was convicted of the crime last year, and a jury sentenced him to death.
At a news conference just before Lunsford’s, Citrus County Sheriff Jeff Dawsy said he was surprised by the lawsuit.
“I was surprised and disappointed,” he said. “We truly believe that this litigation is baseless.

Tomas Delgado, the Spanish businessman who sued the parents of the boy he ran over and killed, apparently had a change of heart and has decided to drop the lawsuit. Who are we kidding — this guy obviously has no soul, and was simply embarrassed by all the negative attention:
On Wednesday, Delgado’s lawyer announced that his client decided to ditch the case because of media pressure, Spanish National Radio reported. He spoke outside the court in the small town of Haro in northern Spain to a crowd of several hundred people.
“We’re very happy,” said Anton Iriondo, father of the cyclist.

Wow, this guy must have one giant set of balls. Tomas Delgado, a businessman in Spain, was doing nearly 100 m.p.h. in a 55 m.p.h. zone when he struck and killed Enaitz Iriondo, 17, who cycled in front of Delgado’s path. It was after dark, and since Iriondo wasn’t wearing reflective clothing or a helmet, Delgado escaped any sort of jail time when the judge ruled both parties at fault. But while most would count their blessings and try to move on with their life, this douche decides to sue the dead boy’s parents for the damage to his car:
Delgado, whose insurance company paid Iriondo’s parents $48,500 in compensation for their son’s life, filed a suit in late 2006 to recover $29,400 in damages to his car and car rental costs, the ministry traffic report said.
“It’s the only way I have to claim my money back,” Delgado was quoted as saying by the newspaper El Pais, which first reported the story on Friday. El Pais said a ruling was expected next week.
Iriondo’s parents were shocked.
“It’s the final straw, a stab in the back,” Iriondo’s mother, Rosa Trinidad said, according to El Pais. “Before the lawsuit we thought the poor guy would find it hard to live the rest of his life with the thought of having caused our son’s death.

Two words - Tort - Reform.
How in the world can a mother blame drug companies for giving her tiny infant an overdose?? No medicine warns you of what is blatently obvious - you don’t take or give 2 of the same medicines and pretend like you’re dispensing one. (Can we sue her for stupidity at an innocent babies expense?)
Alvarez gave her son McNeil-PPC Inc.’s Infant Tylenol Cold Decongestant Plus Cough and Walgreen-brand Pediatric Drops-Cough Plus Cold, according to the lawsuit. Both contain dextromethorphan.
A coroner’s report says Devon Mehlberg-Alvarez died of dextromethorphan intoxication, with tests showing his system metabolized the ingredient slowly, allowing it to build up to toxic levels, according to the lawsuit.
The 41-page lawsuit was filed in Lake County Circuit Court and seeks unspecified damages. It names Deerfield-based Walgreen Co. and McNeil, a unit of New Brunswick, N.J.-based Johnson & Johnson, claiming the companies knew the hazards of dextromethorphan for years but failed to warn consumers.

Wow, it’s not a good month for Vanessa Hudgens. First the nude photos leaked that she supposedly took for crush Drake Bell, and now she’s being sued by her former lawyer.
According to court papers obtained by “Access Hollywood,” a former lawyer for the “HSM” star says she owes him $150,000 in legal fees.
The lawsuit, filed by Brian L. Schall in Los Angeles Superior Court on Monday, alleges a breach of contract and unjust enrichment by the 18-year-old Hudgens.
I just might agree with the “unjust enrichment” part — hey, I’m sorry, but I would rather weed a briar patch naked than sit through High School Musical again — but here’s hoping October is better for Ms. Hudgens and she can take an exit off the Lindsay Lohan Freeway.
